In order to effectively represent somebody in a DWI there’s a few different things you need to look at; the stop of the vehicle is one. If the police officer stops a vehicle for no legal reason then the evidence used in that case may be able to be thrown out. We have to look at that.
Secondly, the field sobriety test. Did the police officer do the field sobriety test the way that the book basically says to do them? It’s called the NHTSA manual and it provides guidelines for how field sobriety tests are done. What we do at this firm is basically take the field sobriety test that they’ve done and see whether or not point-by-point they did it the right way. If they didn’t, that could be a possible weak spot in the case.
In a breath test or a blood test, did a police officer or a chemical analyst do what they were supposed to do in taking that chemical analysis from you? In a breath test, was the machine calibrated properly? In a blood test, was the chain of custody properly followed? And also, finally, you need to look at the video tape. A lot of the times a police officer in his report will write how intoxicated a defendant is, however, you look at the video tape and that’s just not the case, and it sheds light on the possible weaknesses of the case. |
