About Kidnapping Charges & Penalties

Kidnapping is a felony of the third degree, punishable by 2 to 10 years in state prison and/or a fine of up to $10,000. In some circumstances, a defendant may face aggravated kidnapping charges and up to 20 or even 99 years in prison.

Aggravated kidnapping charges may apply in a case where a defendant is accused of kidnapping for ransom, kidnapping to use the victim as a hostage, kidnapping involving sexual abuse or bodily injury or kidnapping to facilitate the commission of a felony or the flight thereof.
