There are three basic types of burglary charges in Fort Worth, all of which are felonies. Types of Burglary

Most people think of burglary as breaking and entering into another dwelling, either a home or a business. This is only half of it. The offender must also have intent to commit a felony, theft or assault. The offender does not have to be successful in this intent. He or she simply must have the intent while breaking and entering. This means that even if the offender is unsuccessful due to, for example, the offender fled the scene, was caught in the act or just wasn't able to commit the felony, the crime has already been committed in the act and intent.

There are three types of felony burglary charges, which are as follows:

  • 3 rd degree burglary is achieved when a person, without the consent of the owner, enters another's business or other dwelling with the intent to commit a theft.
  • 2 nd degree burglary is achieved when a person, without the consent of the owner, enters another's home or habitation with the intent to commit a theft.
  • 1 st degree burglary is achieved when a person enters another's home or habitation with the intent or attempted to commit a felony other than theft.
