Types of Burglary

The offender must also have intent to commit a felony, theft or assault. The offender does not have to be successful in this intent. He or she simply must have the intent while breaking and entering. - 3 rd degree burglary is achieved when a person, without the consent of the owner, enters another's business or other dwelling with the intent to commit a theft.
- 2 nd degree burglary is achieved when a person, without the consent of the owner, enters another's home or habitation with the intent to commit a theft.
- 1 st degree burglary is achieved when a person enters another's home or habitation with the intent or attempted to commit a felony other than theft.
