Sexual Assault Criminal Charges

If you are facing sexual assault allegations or formal charges, you need to involve a competent lawyer to handle your case. You may be in danger of facing serious penalties, including sex offender registration, imprisonment and fines. You may also face a ruined reputation and career due to the nature of these charges. Like any sex crime, sexual assault charges are particularly serious and may impact virtually every area of a defendant's life.

Sexual assault is defined in Section 22.011 of Texas Penal Code. It is generally described as sexual penetration or intercourse committed without the consent of the other person, or with a person who is younger than 17. Without consent may mean that the defendant is accused of physically forcing the victim or threatening the victim or of committing the act against a victim who is mentally or physically incapacitated and therefore unable to give consent.

Sexual assault is typically charged as a felony of the second degree, punishable by up to 20 years in state prison and/or a fine of up to $10,000.
